A Texas man paused his date night to murder a fake parking attendant who had just scammed him out of $40.



29-year-old Erick Aguirre took his date out to Rodeo Goat in Houston, Texas. As the couple began looking for a parking spot a man confronted them. According to reports, a parking attendant, 46-year-old Elliot Nix told Aguirre "it would cost $20 each to park their cars."

After paying the fee, the couple got out and went inside the popular Houston burger joint. However, while in the restaurant, Aguirre was told by an employee that Nix didn’t work for the parking lot and that they had just been scammed.

After learning about the scam, Aguirre paused the date and walked back to his car. A nearby smoke shop employee told police he witnessed the chilling series of events that happened next. 

According to the affidavit, the smoke shop employee witnessed Aguirre run to his car, grab a pistol, and went after Nix. The two men were out of view for a moment but then the employee heard a gunshot.

 Soon after the employee said he saw Aguirre “nonchalantly walking back to his car with the gun in his hand.” before putting the gun back in his car and returning inside the Rodeo Goat, where he continued his date night.

According to court records, Aguirre allegedly told his date “everything was fine” and that he just scared the man after returned from the parking lot. As they began walking to their table, Aguirre looked uncomfortable so they left to eat somewhere else.

Nix was taken to a hospital where he later died from his injuries. Houston Police posted snapshots of the couple asking for tips. Aguirre's date contacted police when she found out about the photos of the two circulating online. “She wanted to do the right thing. She wanted to make sure that she came forward and told the police what she knew,” Rick DeToto, the woman’s attorney told KPRC.

 Aguirre was located and taken in and charged with murder and held on a $200,000 bond. An outside source not related to the case said Aguirre’s attorney will likely be able to make an argument that the use of deadly force was justified.
