An autistic Texas father might be the very first person executed over a case of shaken baby syndrome.

SHAKEN BABY SYNDROME SENDS DAD TO PRISON

In 2002, 57-year-old Robert Roberson arrived at the hospital with his 2-year-old daughter, Nikki Curtis after finding her nonresponsive in her bed. The night before, Roberson claims his daughter had fallen out of bed but didn't think much about it, and after consulting her, he helped put her back to sleep.

However, his young daughter would later die at the hospital and Roberson would later be arrested and charged for the death of his child.

NEW EVIDENCE SUGGESTS A DIFFERENT SITUATION

However, lawmakers are urging for his death sentence to be revoked. New evidence suggests Roberson may not have been at fault for his daughter's death.

A week before his daughter's death, she was in the emergency room for a 104-degree fever and pneumonia. At the time, doctors prescribed the child a medication called Phenergan and cough syrup containing Codeine; both medications that have been deemed "too strong for children."

A startling revelation came to light as Roberson's attorney, Gretchen Sween revealed a shocking and potentially life-changing discovery. Toxicology reports show "potentially lethal levels of Phenergan in Nikki's system upon her death."

Roberson's attorney, Gretchen Sween truly believed her client was not at fault, "There is no doubt in my mind of his absolute innocence."

Roberson is set to receive a lethal injection on Thursday, October 17th, his lawyer is working diligently to stop this life-ending event.
