
15-Year-Old Fires Gun Left Behind by Texas Sheriff at Wendy’s
A Texas sheriff is under fire, metaphorically, after accidentally leaving his loaded firearm behind in a Wendy’s bathroom while visiting Georgia. The weapon was discovered by a teenager and discharged.
Tony Bennie, a sheriff from the Grayson County Sheriff’s Office in Texas, had stopped at a Wendy’s in Georgia with his grandson. According to reports, while in the restroom, Bennie removed his holstered firearm but forgot it after getting distracted by his “unruly” grandson.

A 15-year-old later found the gun and, while handling it, caused it to go off. Thankfully, no one was injured.
Covington Police investigated and consulted the Newton County District Attorney’s Office, which ultimately decided that Bennie’s actions didn’t meet the legal definition of criminal negligence or intent under Georgia law. No charges will be pursued.
Bennie issued a public apology, stating, "I made a mistake. It was unintentional, but it was still a mistake and one I own fully. I am thankful no one was injured, and I hope this serves as a reminder to all gun owners about the importance of constant vigilance, especially around children."

Still, many online aren’t buying the “no harm, no foul” approach. Commenters are calling out the lack of accountability, with one writing, “Unbelievable. Sounds like this sheriff had some privilege extended to him."
Another wrote: “How is there no criminal negligence exactly? I suppose one of the children has to die first?"
Meanwhile, Grayson County’s district attorney, who openly admits he’s known Bennie since high school, backed him publicly, saying the decision to drop charges was made strictly based on the facts.
